Terms and Conditions

1. Definitions

In these Terms and Conditions, the following definitions apply:

  • "Platform" -- the CabinPick website, mobile applications, and related services operated by CabinPick International B.V.
  • "CabinPick", "we", "us", "our" -- CabinPick International B.V., registered under KvK 78527848, BTW NL861437317B01.
  • "User" -- any person who creates an account on the Platform, whether as a Guest, Host, or both.
  • "Guest" -- a User who books a stay through the Platform.
  • "Host" -- a User who lists a vessel or maritime accommodation on the Platform.
  • "Listing" -- an advertisement for a maritime accommodation published by a Host on the Platform.
  • "Booking" -- a confirmed reservation of a Listing by a Guest.
  • "Service Fee" -- the fee charged by CabinPick for facilitating a Booking, currently set at 12% of the subtotal.
  • "AI Concierge" -- the AI-powered chat assistant available on the Platform.
  • "Gift Card" -- a prepaid digital voucher purchased through the Platform.

2. Platform Usage

2.1. CabinPick is a marketplace platform that connects Guests with Hosts offering maritime accommodations. CabinPick is not a hospitality provider, travel agent, or insurer. We facilitate the connection between Guests and Hosts but are not a party to the accommodation agreement between them.

2.2. To use the Platform, you must be at least 18 years of age and have the legal capacity to enter into binding agreements. By creating an account, you represent and warrant that you meet these requirements.

2.3. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised use of your account.

2.4. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the Platform in any way.

3. Booking and Cancellation Policy

3.1. Booking Process

A Booking is created when a Guest selects dates, confirms the number of guests, and completes payment. The Booking enters a "Pending" state until the Host accepts or declines the request. A Host must respond within 48 hours, after which the Booking is automatically cancelled and the Guest is fully refunded.

3.2. Cancellation by Guest

  • 24+ hours before check-in: Full refund of the subtotal. The Service Fee (12%) is non-refundable.
  • Less than 24 hours before check-in: 50% refund of the subtotal. The Service Fee (12%) is non-refundable.
  • No-show: No refund.

3.3. Cancellation by Host

If a Host cancels a confirmed Booking, the Guest receives a full refund including the Service Fee. Repeated cancellations by a Host may result in reduced listing visibility, account warnings, or account suspension.

4. Payment Terms

4.1. All payments are processed securely through Stripe. CabinPick does not store full credit card numbers. By making a payment, you agree to Stripe's terms of service.

4.2. The total Booking amount consists of: the accommodation subtotal (set by the Host), any selected extras, and the Service Fee (12% of the subtotal). The Service Fee is non-refundable except in cases of Host cancellation or Platform error.

4.3. Prices are displayed in euros (EUR) unless otherwise stated. All amounts are inclusive of applicable VAT where required.

4.4. Host payouts are processed within 3 business days after the Guest's confirmed check-in. Payouts are made to the IBAN provided by the Host in their account settings.

4.5. CabinPick bank account for reference: IBAN NL09INGB0000000000 (CabinPick International B.V.).

5. Host Obligations

As a Host on the Platform, you agree to:

  • Provide accurate and up-to-date listing information, including photographs, pricing, and availability
  • Maintain your vessel in a safe, clean, and habitable condition that meets all applicable maritime safety regulations
  • Respond to booking requests within 48 hours
  • Honour confirmed Bookings and provide the accommodation as described in the Listing
  • Comply with all local laws, regulations, and permit requirements for short-term accommodation
  • Maintain valid insurance for your vessel and liability coverage for guest stays
  • Report your income from CabinPick to the relevant tax authorities
  • Not discriminate against Guests on any legally protected grounds

6. Guest Obligations

As a Guest on the Platform, you agree to:

  • Provide accurate personal information when creating a Booking
  • Treat the Host's vessel with care and respect, and follow all house rules specified in the Listing
  • Not exceed the maximum number of guests specified in the Booking
  • Report any damage to the vessel promptly to the Host and to CabinPick
  • Vacate the vessel by the agreed check-out time
  • Not engage in any illegal activity during your stay
  • Provide honest and fair reviews after your stay

7. Gift Cards

7.1. Gift Cards can be purchased in amounts between EUR 50 and EUR 500 and may be applied as (partial) payment toward any Booking on the Platform.

7.2. In accordance with the Dutch Wet van Dam (Article 7:2d BW), Gift Cards are valid for a minimum period of two (2) years from the date of purchase. The expiry date is stated on the Gift Card.

7.3. Gift Cards are non-refundable and cannot be exchanged for cash, except where required by law.

7.4. If a Booking paid (in part) with a Gift Card is cancelled, the refundable amount is credited back to the Gift Card, not to the original payment method.

8. Liability

8.1. CabinPick acts solely as a marketplace platform. We are not liable for the condition of any vessel, the conduct of any Host or Guest, or any loss, injury, or damage arising from a stay booked through the Platform.

8.2. Hosts are solely responsible for ensuring their vessels comply with safety regulations, hold appropriate insurance, and are as described in the Listing.

8.3. CabinPick's total liability for any claim arising from or related to these Terms shall not exceed the total Service Fees paid by the claimant in the 12 months preceding the claim.

8.4. Nothing in these Terms shall limit CabinPick's liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Dutch law.

9. Dispute Resolution

9.1. In the event of a dispute between a Guest and a Host, both parties are encouraged to first attempt to resolve the matter directly. CabinPick may, at its discretion, mediate disputes but is not obligated to do so.

9.2. If a dispute cannot be resolved informally, it may be submitted to the competent court in the Netherlands.

9.3. European consumers may also file a complaint via the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

10. Governing Law

10.1. These Terms and Conditions are governed by and construed in accordance with the laws of the Netherlands.

10.2. Any disputes arising from or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts in the Netherlands.

11. AI Concierge Disclaimer

11.1. The AI Concierge is provided as a convenience tool to assist Users in finding listings, answering questions, and managing bookings. The AI Concierge is powered by large language models and may occasionally provide inaccurate, incomplete, or outdated information.

11.2. The AI Concierge does not constitute professional advice (legal, financial, maritime safety, or otherwise). Users should independently verify any information provided by the AI Concierge before making decisions.

11.3. CabinPick is not liable for any loss, damage, or inconvenience arising from reliance on information provided by the AI Concierge.

11.4. Conversations with the AI Concierge are logged for quality assurance and service improvement. See our Privacy Policy for details on data handling.

12. Changes to These Terms

12.1. CabinPick reserves the right to modify these Terms at any time. Material changes will be communicated to Users via email or a prominent notice on the Platform at least 30 days before they take effect.

12.2. Continued use of the Platform after the effective date of any changes constitutes acceptance of the updated Terms.

12.3. If you do not agree with the updated Terms, you may close your account at any time through your account settings or by contacting us at info@cabinpick.com.
